Gem Stone Music JA
The terms that apply to using Gem Stone Music JA, booking talent and buying tickets.
Effective 31 October 2026 · Version 2.0
These terms are between you and Gem Stone Music Consultants Limited (“Gem Stone”), which operates the Gem Stone Music JAplatform: artist and influencer bookings, event listings, ticketing, community features and the tools that support them.
Some events are provided by Gem Stone directly and others are listed for approved third-party promoters. Each listing identifies the provider and applies the provider’s event-specific commercial terms.
These terms apply to visitors and account holders. Where a specific document governs an activity, that document also applies: the Booking Client Terms for booking talent, the Professional Communication Policy for booking conversations, the Marketplace Participation Agreement for talent and management, the Event Promoter Master Agreement for promoters, the Cancellation & Refund Policy for payments, and the Community Guidelines for content and conduct.
By creating an account or using the platform you agree to these terms. If you do not agree, do not use the platform.
Gem Stone operates a marketplace and coordination service. For talent bookings, Gem Stone is not the performer, the employer of talent, or a party to the performance itself; it coordinates the enquiry, holds the commercial terms, collects payment, and administers commission.
For ticketing, Gem Stone provides ticketing services for its own events and for approved promoters, and each listing identifies who is responsible for delivering the event.
Gem Stone is not a bank, escrow service or licensed payment institution. Payment processing is performed by an authorised provider.
You must be at least 18 years old to hold an account, and to make a booking or buy a ticket in your own name. A parent, guardian or authorised school representative may act for a minor event attendee.
You must provide accurate information, keep access credentials secure, and are responsible for activity under your account. One person should not maintain duplicate accounts to avoid restrictions.
We may ask for information needed to keep the platform secure or to meet a legal obligation.
An account can hold several capabilities at once, granted separately:
Gaining one capability does not grant another. Approval decisions are made by Gem Stone and can be reviewed through the Complaints & Appeals procedure.
Booking Client activation is immediate once the required information and acceptances are complete. Professional capabilities require onboarding, documented approval, and acceptance of the applicable agreement.
Professional verification may require an identity check with our verification provider, and may also be granted by an administrator where our rules permit it. A successful identity check does not itself grant a verified badge: approval is a separate decision, and it can be refused, or later revoked where information proves inaccurate.
Verification decisions, applications and their revisions are recorded, with the reason shared with the account holder. Internal review notes are not shared.
A booking enquiry is not a confirmed engagement. An enquiry becomes binding only through a signed booking agreement and Gem Stone’s written confirmation, subject to the checks described in the Booking Client Terms.
For new Management Represented and Independent/Self-managed marketplace bookings, commission is 5% of the full agreed booking price, collected entirely from the initial 50% deposit. No further commission is charged on the remaining balance. Processing charges are separate, allocated explicitly before acceptance, and never reduce the commission base.
Management teams and independent talent must also accept the Marketplace Participation Agreement before new marketplace activity; it is not part of these Terms.
Contact release requires both parties to accept the current agreement, a server-verified cleared deposit, full commission allocation, Gem Stone approval, completed availability checks and booking confirmation. The remaining balance, conversations and changes stay on the platform. Payment alone does not confirm a booking.
Existing Gem Stone Direct and historical accepted agreements are preserved. Material price changes require a new accepted agreement version. Commission collected upfront is not automatically non-refundable; the Cancellation & Refund Policy explains how commission is handled when a booking is cancelled or reversed.
These commission rates are unchanged by these terms and are not affected by any other document.
Listings must be accurate as to date, venue, performers, prices, admission conditions and age restrictions. Event-specific terms are shown before payment and cannot override mandatory consumer rights or the published refund protection.
Prices, mandatory fees and the charged currency are visible before payment. Local-currency equivalents are estimates unless they are the actual charged currency.
Tickets are valid only for the event, holder and admission category stated, and are not transferable or available for unauthorised resale. Duplicated, fraudulent or resold tickets are not valid and may be refused entry. Admission remains subject to venue rules and lawful security checks.
Promoters must disclose event-specific commercial terms through an approved Event Commercial Schedule before sales open. Gem Stone does not impose a universal processing-fee allocation on promoters: each event’s approved schedule governs its own fees.
Live payment processing is enabled only once a gateway, security testing and merchant approval are complete. At the date of these terms no live gateway is connected, so only sandbox (simulated) payments are available. Sandbox payments do not involve real funds and do not confirm a purchase for live admission.
When live processing is enabled, the applicable fees and charges will be disclosed before payment, and receipts will identify what was charged.
Refunds and cancellations are governed by the Cancellation & Refund Policy.
Registered users may follow eligible artists, influencers and events, and choose individually whether a followed profile sends in-app updates. Following does not create any professional relationship, and does not grant access to private conversations or confidential information.
Email and push notifications for follow updates are not currently offered.
You may post content and comments. You keep ownership of what you publish and grant Gem Stone a non-exclusive, worldwide licence to host, display and promote that content on and about the platform for as long as it remains published.
You must not publish content that is unlawful, defamatory, harassing, hateful, fraudulent, misleading, impersonating another person, infringing intellectual property, or that shares someone else’s private information without permission.
Users can report content and profiles. We may remove content, issue warnings, restrict features or suspend accounts under our Community Guidelines. Moderation decisions can be appealed.
If you believe content infringes your rights, report it and identify the material and your basis for the claim.
The Gem Stone Music JA name, branding, platform design, event listings and our own content are protected by intellectual property rights. You may use the platform for its intended booking, ticketing and community purposes.
You may not copy, scrape, redistribute or commercially exploit our content or another user’s content without permission, or use the platform’s marks in a way that suggests endorsement.
Booking conversations must take place through the platform. Sharing contact details in order to move a booking off the platform, or arranging payment outside it, is prohibited and is screened for automatically.
The Professional Communication Policy sets out what is permitted, how screening works, and what happens when a rule is broken. It must be accepted before professional messaging is enabled.
You must not misuse the platform, including by attempting unauthorised access, interfering with security features, evading a restriction or suspension, submitting false information, impersonating another person, scraping data, or using automated tools to obtain content or tickets.
We may suspend or restrict accounts where these rules are broken.
We may restrict a feature, suspend an account or terminate access where: these terms or a linked policy are broken; fraud, abuse or a security risk is suspected; verification proves inaccurate; a legal or regulatory requirement applies; or an account is inactive and subject to our retention review.
Where we take such action we tell you the reason and the route to appeal, except where doing so would compromise an investigation, affect another person, or breach a legal restriction. Restrictions apply only to the capability affected where that is a proportionate response.
Ending an account does not cancel financial obligations already incurred, does not remove records we must keep, and does not affect tickets already purchased for a live event.
Complaints about moderation, verification, account restrictions and booking decisions are handled under the Complaints & Appeals procedure, which explains what to submit and what happens next.
Complaints about charges or refunds follow the Cancellation & Refund Policy.
Nothing in these terms excludes or limits liability for fraud, fraudulent misrepresentation, death or personal injury caused by negligence, or any liability that cannot lawfully be excluded.
Subject to that, Gem Stone is not liable for losses that were not reasonably foreseeable when the agreement was made, for loss of profit, goodwill or opportunity, or for the acts and omissions of independent talent and third-party promoters outside our control.
Where Gem Stone is responsible for the failure of a paid service, our liability is limited to the amount paid to Gem Stone for the affected service, except where the law provides otherwise.
The platform is provided with reasonable care and skill, but we do not warrant uninterrupted or error-free operation. We maintain the security measures described in our Privacy Notice.
Our Privacy Notice explains what information we collect, why, who it is shared with and the rights available to you. The Cookie & Tracking Policy explains the storage we use and how optional analytics is controlled.
Where you provide another person’s information, for example a booking contact for an organisation, you confirm you are authorised to provide it.
These terms are governed by Jamaican law, subject to mandatory consumer rights and applicable jurisdiction rules.
We ask that you raise a concern with us first. Where a matter cannot be resolved through our complaints procedure, it may be brought before the competent Jamaican courts, or another forum where consumer law requires it.
We may update these terms to reflect new services, legal requirements or changes in how the platform operates. The current version and effective date are shown at the top of this page.
Where a change is material, we present the updated version for acceptance before the affected activity continues. An earlier version is never deleted: it remains on record with the acceptances that named it, and an earlier short checkbox is not treated as acceptance of wording published later.
